SNOWTEAM   -   TERMS AND CONDITIONS

JURISDICTION – The contract is made on the terms of these booking conditions which are governed by English law and both parties shall submit to the jurisdiction of English courts at all times.

CONTRACTS – No contract shall exist between the client, which expression shall include all persons on whose behalf the client books, and The Snowteam, until a signed booking form shall have been received with deposits or full payment as applicable and a confirmation invoice issued by The Snowteam. Deposits, per person are £100.  In the case of telephone bookings made within 8 weeks of departure, where payment is made by visa or access credit card, a contract shall come into existence immediately we orally confirm the booking.  By making such a booking you are deemed to have accepted these booking conditions which form the basis of all contracts.  We will send you a copy of the terms and conditions with you invoice.

PAYMENT – Full payment, less any deposit pre-paid shall reach The Snowteam not less than 8 weeks prior to departure.  The client who signed the booking form shall be liable for full payment for all those persons whom the form applied and for other persons The Snowteam was subsequently requested to book and in respect of whom The Snowteam issued an invoice.  If payment shall not have been received by the due date, The Snowteam shall have the right to cancel the booking, retain the deposit paid and levy cancellation charges.

PRICES – Once your holiday has been booked we reserve the right to levy surcharges in the event of government action, both UK and French, such as increases in VAT and currency fluctuation in relation to adverse exchange rates.  Should any client choose to cancel their holiday because of this, he must exercise his right to do so within 14 days from the issue date printed on the invoice.

AMENDMENTS BY THE CLIENT – The Snowteam will do all it can to comply with any changes that are requested but cannot guarantee to do so.  If we are able to accept the change a minimum fee of £25 per person will apply.  However, any changes made within 8 weeks of departure may be treated as a cancellation and cancellation charges will apply.  If the change is to increase the number of persons booked, or a change of name, no amendment or cancellation charge will apply.

CANCELLATION BY THE CLIENT – Cancellation shall take effect only when written notification from the person signing the booking form is received by The Snowteam.  In all cases of cancellation the deposit will be forfeited.  The following cancellation fees expressed as a percentage of the total holiday cost will become immediately payable to The Snowteam:

LATE ARRIVALS – The Snowteam can take no responsibility for clients arriving late or delayed at the airport or in the resort.

PASSPORTS, VISAS AND HEALTH REQUIREMENTS – Clients are responsible for the provision of all necessary valid documents covering all members of the party.

INSURANCE – clients should note that it is a condition of booking with The Snowteam that all members of the party have adequate insurance cover and clients are responsible for the provision insurance for all persons who have booked a Snowteam holiday.  Clients may be asked to provide a copy of their insurance cover in some circumstances.

ALTERATION BY THE SNOWTEAM – Arrangements for holidays are made many months in advance and changes can occur.  We must reserve the right to make alterations to holiday and website details before and after any booking has been confirmed.  Most of these changes are minor and in all cases we will advise you at the earliest possible date. If a significant change becomes necessary you will have the choice of accepting the change in arrangements, purchasing another holiday from us and paying or receiving any price difference or cancelling your holiday and receiving a prompt and full refund.  In all cases of a significant change, we will pay you compensation as detailed below except where the change is made as a result of circumstances set out in the important note below.  No compensation is payable in respect of minor changes and no other claim for compensation or expenses will be accepted.

IMPORTANT NOTE – Compensation will not be payable if we are forced to cancel or in any way change your holiday due to war, threat of war, riot, civil strife, industrial action or dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or circumstances amounting to force majeure.

CANCELLATION BY THE SNOWTEAM - We reserve the right in any circumstances to cancel your holiday, and all holidays operate subject to a minimum number of participants.  However, in no case will we cancel your holiday less than 8 weeks before the scheduled departure date except for reasons of force majeure or failure on your part to pay the final balance.

COMPLAINTS  -  In the unlikely event of there being something not to your liking or should a problem occur during your holiday please inform a member of The Snowteam on the Resort as soon as possible.  We will then make every effort to amend the problem.  If the complaint cannot be resolved in the resort please write to us at The Snowteam Ltd, 14 High Street, West End, Southampton SO30 3AA within 28 days of your return from holiday, giving all relevant information.  We regret we cannot accept liability in respect of any complaints which are not notified in accordance with this clause.  Disputes arising out of or in connection with this contract which cannot amicably be settled may, if you so wish, be referred to arbitration, arranged with the Travel Trust Association and administered quite independently by the Chartered Institute of Arbitrators.  The Travel Trust Association address is:  Albion House, High Street, Woking, Surrey  GU21 6BD.

ACCOMMODATION – The accommodation provided is only for the use of clients shown on the booking form and sub-letting, sharing or assignment is prohibited.

DAMAGE AND BEHAVIOUR BY THE CLIENT -  Any  damage will be charged to the client and must be paid before vacating the accommodation.  The client undertakes to behave in an orderly fashion and not to disrupt the enjoyment of others on holiday or in any way harm the reputation of The Snowteam, the owners of its accommodation or its suppliers.

THE SNOWTEAM LIABILITY – We accept responsibility for ensuring that the holiday which you book with us is supplied as described on the Website and the services offered reach a reasonable standard.  If any part is not provided as promised, we will pay you appropriate compensation.  We accept responsibility for the acts/omissions of our employees, agents, suppliers and sub-contractors where they were at the time acting within the course of scope of their employment or contract of supply, save where they lead to death, injury clause below.  Our liability is limited to the relevant holiday price of the persons (s) affected in total.  In the case of loss and/or damage to luggage or personal possessions (including money), we have no liability as you are assumed to have taken out the appropriate insurance cover before travelling.

WEBSITE INFORMATION  - The information contained within The Snowteam is correct to the best of our knowledge.  Furniture and room arrangements are subject to change.  However, the client should bear in mind that in relation to the information given about the resorts and certain of the facilities we cannot guarantee accuracy at all times or that any particular activity will take place as these services are not under our control.

PERSONAL INJURY  -  We accept responsibility should you suffer death, personal injury or illness as a result of any failure to perform or improper performance of any part  of our contract with you by any of our employees, agents, suppliers or sub-contractors providing they were at the time acting within the course of their employment except where any failure to perform or improper performance was due to acts and/or omissions or those of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or an event which either ourselves or the supplier of the services (s) in question could not have foreseen or forestalled even with all due care.  It is however a condition of this acceptance of liability that you notify us of any claim in writing within 28 days or your return from holiday.  In the event of such a payment being made, you must assign The Snowteam and/or our insurers all rights you may have to pursue a claim against any third party and to provide ourselves and our insurers with all the assistance necessary.

SKIING WITH THE SNOWTEAM -  If you ski with a representative of The Snowteam whether on an organised session or not The Snowteam cannot take any responsibility for injuries however caused.  At all times, and in all circumstances, clients must use their own abilities, and all skiing is at their own risk. As aforesaid, the Snowteram has assumed every person booking has taken out a Travel Insurance Policy for each member of their group.
